ELIGIBILITY
NO PURCHASE NECESSARY. LetsTalk.com’s “The Ultimate HD7 Gamers” Giveaway is open only to individuals who are legal residents of the 50 United States or District of Columbia who are 18 years of age or older. Employees and their immediate families (spouses, parents, children, siblings and their spouses) of LetsTalk.com, its affiliates, advertising, promotion or consulting agencies, and paid advertisers of LetsTalk.com are not eligible. All federal, state, and local laws and regulations apply.

AGREEMENT TO OFFICIAL RULES
Participation in the LetsTalk.com’s “The Ultimate HD7 Gamers” Giveaway constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of LetsTalk.com (Sponsor), which are final and binding. Winning the prize is contingent upon fulfilling all requirements set forth herein.

ENTRY PERIOD
The Giveaway commences Tuesday March 22nd, 2011 (12:00am PST). The last entry will be accepted on Thursday March 31st, 2011 (12:00am PST).

HOW TO ENTER
To enter the Giveaway, you must either “Like” the LetsTalk.com Facebook page OR Follow and Tweet using hashtag #HD7X through Twitter. If you are already a fan of our Facebook page then you are already entered to win. Already following us on Twitter? Then all you have to do is Tweet about the giveaway using the hashtag #HD7X. Entering into both WILL increase your chances of winning. Only one (1) entry per person through Twitter and Facebook during the promotion period is permissible. Use of any automated system to participate is prohibited and will result in disqualification.

PRIZE
Grand Prize: One (1) winner will be randomly selected to receive one (1) HTC HD7 for T-Mobile, Xbox 360, Xbox Kinect, and a one year Xbox Live Gold Card. All will have full manufacturer’s warranty. PHONE DOES NOT INCLUDE SERVICE. Such is the case with any Smartphone, purchasing a data plan will be necessary for entrants who don’t already have a data plan. By accepting the prize the winner is responsible for any additional purchases associated with the carrier (activation fees, service plans, data plans, features, accessories, taxes, fees, etc.)

Bonus Prize: One (1) winner a day from March 23rd 2011 to March 30th 2011 (excluding weekends) will win a HTC HD7 and a one year Xbox Live Gold Card.

SELECTION AND NOTIFICATION OF WINNER
Grand Prize: At the conclusion of the entry period, LetsTalk.com will select the name of the winner in a random drawing of all eligible entries received during the entry period. The odds of winning depend upon the number of valid entries received. Winner will be required to complete an Affidavit of Eligibility, Liability and Publicity Release when claiming prize. The Affidavit must be returned within (4) days of being notified and if isn’t then the potential winner will be deemed to have forfeited the prize, and an alternate potential winner will be chosen. LetsTalk.com will notify the winner via a direct message through their Facebook or Twitter account with the subject entitled “The Ultimate HD7 Gamer”. Responding to the message is required by Wednesday April 4th 2011 11:59pm (PST) and must include your full name, valid email address, and current or soon-to-be current carrier. If selected winner does not respond by the aforementioned deadline LetsTalk.com reserves the right to select an alternate winner in his/her place at random from all eligible entries. The affidavit will be sent to you the day you respond. As soon as we receive the winners Affidavit of Eligibility, Liability and Publicity Release we will announce the winner on the LetsTalk.com site. Announce date may be changed if a new winner needs to be selected. Grand Prize winner will be selected on March 31st.

GENERAL CONDITIONS
In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, LetsTalk.com may in its sole discretion, either; (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, LetsTalk.com reserves the right to seek damages from any such person to the fullest extent permitted by law. LetsTalk.com’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In case of a dispute as to the owner of an entry, entry will be deemed to have been submitted by the authorized account holder of the Facebook profile name from which the entry is made.

RELEASE AND LIMITATIONS OF LIABILITY
By participating and accepting the prize in the Giveaway, entrants agree to release and hold harmless the Giveaway Entities from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt of any prize. Entrant further agrees that in any cause of action, the Giveaway Entities' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Giveaway Entities be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
